1. Who these terms apply to
These terms of service (“Terms”) form a binding agreement between you and FOOD AND VEGETABLES LTD, a private company limited by shares registered in England and Wales (“we”, “us”, “our”). Our full statutory registration details are available on request.
By accessing or using our website foodvegetables.site (the “Site”), our mobile application (the “App”), or any of our services (together, the “Services”), you agree to these Terms. If you do not agree to these Terms, please do not use the Services.
2. Eligibility
You may use the Services only if you are at least 18 years old and able to form a binding contract under the laws of England and Wales. If you are using the Services on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
3. Accounts
Some parts of the Services require you to create an account. You agree to provide accurate and current information, keep your credentials confidential, and notify us promptly at legal@foodvegetables.site of any unauthorised access. You are responsible for all activity that takes place under your account.
4. Orders, pricing & payment
- All prices are quoted in GBP and include applicable UK VAT unless stated otherwise. Delivery charges, where applicable, will be shown before you confirm your order.
- Placing an order is an offer by you to purchase products subject to these Terms. A contract is formed only when we send you a confirmation email accepting your order.
- We may refuse or cancel any order at our discretion, including where stock is unavailable, a pricing error has occurred, or we suspect fraud. If we cancel, we will refund any amount already paid.
- Payment is processed by our third-party payment providers. By placing an order you authorise us (and our payment providers) to charge the relevant payment method for the total order amount.
5. Deliveries
- We aim to deliver within the windows shown at the time of ordering, but delivery times are estimates and not guaranteed.
- Risk in the products passes to you upon delivery to the address you provided.
- If no one is available to receive a delivery, our courier may leave it in a safe place, attempt redelivery, or return it to us, depending on local arrangements.
- Please check your order promptly on arrival. For fresh produce, any quality issue must be reported within 24 hours of delivery to qualify for a refund or replacement.
6. Subscriptions
- Where you subscribe to a recurring service (e.g. a weekly vegetable box), we will charge the applicable amount on each renewal date until you cancel.
- You may pause, amend, or cancel a subscription at any time through your account, the App, or by emailing us — subject to the cut-off time published in your account for the upcoming delivery.
- We do not charge cancellation fees.
7. Your right to cancel (consumers)
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, perishable goods (such as fresh produce) are generally exempt from the statutory 14-day right of withdrawal. However, we stand behind the quality of what we send — if any item arrives in poor condition or is materially different from what you ordered, we will refund or replace it promptly. Please contact hello@foodvegetables.site within 24 hours of delivery.
8. Acceptable use
When using the Services you agree not to:
- use them for any unlawful purpose, or in any way that could damage, disable, overburden, or impair them;
- attempt to gain unauthorised access to our systems or to other users’ accounts;
- introduce viruses, malware or other malicious code;
- scrape, copy, or republish substantial parts of the Services without our prior written permission;
- misuse any reporting, review, or messaging feature to harass, defame, or mislead.
9. Intellectual property
All content on the Site and in the App, including text, imagery, branding, software, and design, is owned by or licensed to FOOD AND VEGETABLES LTD and is protected by UK and international intellectual-property laws. You are granted a limited, revocable, non-exclusive licence to access and use the Services for their intended purpose. No other rights are granted.
10. Disclaimers
The Services are provided on an “as is” and “as available” basis. We do not warrant that the Services will be uninterrupted, error-free, or entirely free of defects. Nothing in these Terms excludes or limits statutory rights you may have as a consumer under UK law.
11. Liability
- Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.
- Subject to the above, our total liability to you arising out of or in connection with the Services will not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) £100.
- We are not liable for indirect or consequential loss (including loss of profits, business, or data) arising from your use of the Services.
12. Suspension & termination
We may suspend or terminate your access to the Services if you breach these Terms, if required by law, or if we discontinue any part of the Services. You may stop using the Services at any time. Termination does not affect rights or obligations that have already accrued.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top and, where the change is material, notify you via email or through the Services before the change takes effect. Continued use of the Services after an update constitutes acceptance of the updated Terms.
14. Governing law & jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that consumers based in Scotland or Northern Ireland may bring proceedings in their local courts.
